Senate “Anti-Phishing” Bill Threatens Domain Owners and Small Business

U.S. Senator Olympia Snowe has introduced, the “Anti-Phishing Consumer Protection Act of 2008” (APCPA). The bill is cosponsored by Senators Bill Nelson (D-FL) and Ted Stevens (R-AK), the man who famously referred to the internet as a “series of tubes.”

This bill is in fact, not truly about phishing so much as it is a direct blow to legitimate domain owners and small business.

Closer Look at the Fine Print

The good (bad) stuff starts on page 6 of the document and continues to completely destroy domain WHOIS privacy as we know it today. This section alone should be encouragement enough to fight against the passage of this bill.

(c) WHOIS Database Information Accuracy-

(2) DOMAIN NAME REGISTRARS, REGISTRIES AND OTHER AUTHORITIES – It is unlawful for a domain name registrar, registry or other domain name authority, directly or indirectly, via proxy or any other method, to replace or materially alter the contents of, or to shield, mask, block, or otherwise restrict access to, any domain name registrant’s name, physical address, telephone number, facsimile number, electronic mail address, or other identifying information in any WHOIS database or any other database of a domain name registration authority if such registrar, registry, or domain name authority has received written notice, including via facsimile or electronic mail at such entity’s facsimile number or electronic mail address of record, that the use of such domain name is in violation of any provision of this Act.

The Five Most Commonly Encountered, Off-putting E-commerce Errors

Are abandoned shopping carts continuing to wreak havoc on your online sales? If so, perhaps it’s your Web site that’s driving your visitors away.

Marcia Yudkin, Internet marketing expert and the author of Poor Richard’s Web Site Marketing Makeover, knows what makes or breaks an e-commerce Web site. Having recently judged a raftload of sites for the Webby Awards and the Inc. Web Awards, her first hand knowledge of e-commerce blunders and how to avoid them can help you convert more visitors into buyers.

If you want to be a successful online retailer, Yudkin suggests you avoid these five common irritants and obstacles:

Lack of quick orientation for first-time visitors
What does the site sell? “I’ve had to poke around for several minutes sometimes to understand the focus of a site,” Yudkin says. “Jargon is one culprit. Another is lack of context, like an airline site that sells tickets not giving a single clue on the home page in what countries or even what continent it flies.”

Explanations that don’t explain
What does the product do and not do? “Another basic, but it happens often that a site doesn’t explain whether their “Turbocharge VT27-Plus” is a one-time download, a subscription, a Web-based service or something else,” notes Yudkin. “An alternative payment system’s site failed to offer a clear, systematic description of how it works.”

Missing prices and shipping charges
How much? “You shouldn’t have to put something into a shopping cart or enter your credit card information to learn how much an item costs, including shipping,” says Yudkin. “Unfortunately, you still find this mistake at sites that have had plenty of time to get their act together.”

Unreadable text
Say what? “Creativity gone haywire seems to be the hallmark of some Web designers,” Yudkin charges. “Orange letters on a blue background, olive green on black, light gray on white and blue on blue were combinations that sent me packing, as did lettering too small for over-40 eyes.”

Inconsistencies
Huh? One site says, “To sign up, click on the Sign Up link at the top of every page.” But the site does not have any “Sign Up” link, only “Sign In.” “Such carelessness wastes the time of earnest shoppers and gets them frustrated and fed up, never to return,” Yudkin comments.

What’s a Retailer To Do?

By making sure your site isn’t creating any of these obstacles, retailers can reduce shopping cart abandonment and create happier, more satisfied customers.

“Blunders are equally rampant at well-funded corporate sites and those from home-based businesses,” notes Yudkin. “The good news is that many of the errors are extremely easy and inexpensive to fix.”

Yudkin also offers tips for small retailers who want to makeover their Web sites to stand out from their competitors. These inexpensive ideas can make a big difference in your online success and help drive business to your physical store:

1. Take advantage of your Mom & Pop status, if you fall into that category, and make the site reflect your personality and your geographical location.

2. Add community-oriented, local features that the national retailers wouldn’t be able to compete with.

3. Be responsive and personal to people who email you – something the big sites usually can’t manage well.

4. Include your phone number and a map to get to your store. Some people finding your Web site won’t be familiar with your city or town.

5. State your store hours and make sure they’re up to date. You’ll make people angry if they show up when your Web site said you’d be open and you’re not.

Internet real estate or should we just call it a dotcom for short, It is a multi million dollar business. Why is buying and selling of dotcoms became so popular in the past few years? Well tell you the truth it has been a very popular business for almost a decade. Is the dotcom business really truly worth millions? I have ventured out into the dotcom world in the last couple years and I thought I would share some things with everyone that is or might be venturing out into internet real estate. I myself pretty much do my buying myself I do not a have an office full of thinkers and buyers. You are thinking an office full of thinkers? Yes I said it, because I do not have a bunch of guys thinking of dotcom names or how many ways they can twist four letters in to not taken dotcoms yet. I also do not have an office full of buyers either, Buyer are the people that sit and buy up dotcoms as they one either expire or two the come up for sale via auction. I pretty much do it myself I play both thinker and buyer. I prefer the buyer over the thinker; I enjoy the rat race of watching multiple screens and multiple computers. I can say I also get the thrill of researching and putting work into finding not only dotcoms I might want for my personal portfolio but also for my buy sell portfolio. I would say my favorite part is finding the right aftermarket dotcom as it may be from SEDO or EBay. Now the thinker part I also play as well, making and finding dotcoms does not always come easy. As you think of a good name you also must go out and make sure that someone else has not already grabbed your next great idea. Then of course there are the names that are out there that you have researched that you just might have to have so then you have to put them on back order. Depending on your income and expensive will depend on where you can go in the internet real estate market. There are all kinds of ways you can get dotcoms. You make them and buy them yourself, Just need to find a place that you want to buy them. Today there are gods so many places on the internet that sell dotcoms. I prefer and use Gizmo’s Domains, I also like Go Daddy and I have used 1&1 before as well. If you want to buy them from an auction there are several places out there that offer auctions. I have used EBay, Domain Name Aftermarket.com, SEDO and there are tons more. You can also Back Order a domain name if you know it is expiring soon. Trust me when I tell you though you are not always guaranteed to get that domain name. I tell people all the time what I do in my spare time and they look at me funny and say well what are you going to do with all those domains? Well you can always make money from them if you are not selling them, you can park them you can make them into an Ad Sense site, and there are all kinds of ways to make money off a dotcom. You are truly buying a piece of the internet; it is like owning a piece of real estate. You can buy, hold, sell and even just keep and make money with them. So back to my original question is it a multi million dollar business? Yes it is and truly can be. I have my good fortune in the internet real estate business, I have bought and sold and I have bought to keep for personal sites as well. I have bought several and different types of the dot industry. I hope that if you’re venturing into the internet real estate that you see your fortune can be what you make it to be as it is a booming business that is far from ending anytime soon.
